Katy Rideshare Accident Attorney

Rideshare companies like Lyft and Uber provide a convenient service, but their drivers cause collisions just like any other motor vehicle operator. When a passenger, occupant of another vehicle, or non-occupant such as a pedestrian gets injured because of a rideshare driver’s negligence, the victim can file a personal injury claim against the driver or the rideshare company. To learn more, our Katy rideshare accident attorneys at The West Law Office can answer any questions you may have.

Who Can File a Personal Injury Claim in a Katy Rideshare Accident

  • Passenger of the rideshare car;
  • Occupant of another vehicle struck by the rideshare driver;
  • Non occupant, such as a pedestrian or cyclist, struck by the rideshare driver; and
  • Driver of the rideshare car, assuming another party caused their injuries.

Uber and Lyft’s Insurance Policies For Victims of Their Rideshare Drivers

Rideshare crashes caused by the rideshare driver may be covered by the app company, depending on whether the app was on, if there were passengers in the rideshare car, or if the driver was en route to pick up a passenger. Uber and Lyft have the same liability insurance policies, described below:

  • Uber or Lyft App was on and the Driver Had Passengers in the Vehicle or Was en Route to Pick up Passengers—If a driver had passengers in the car or was en route to pick up a passenger, there is a $1 million liability policy to work with.
    • $1,000,000 bodily injury liability per person
    • Actual cash value of the car (Contingent Comprehensive Collision Plan)
  • Uber or Lyft App was on and the Driver was Waiting for a Ride Request—Many rideshare collisions occur when the driver is simply roaming about, waiting for a ride request. In fact, studies have found that in some cities, traffic has increased by double digit percentage points due to rideshare vehicles. They may be convenient when you need them, but they add traffic, and collisions, to our streets.
    • $50,000 bodily injury liability per person
    • $25,000 property damage liability
  • Uber or Lyft App Was Off—Neither Uber nor Lyft is liable for the collision. If the driver was not using the app, they can be thought of as “off the clock.” Even though Uber and Lyft drivers are technically not employees, only when the app is on is a rideshare company liable for damages. However, you are still free to file a personal injury lawsuit against the driver themselves.
